For those still undergoing AOS, EAD/AP applications, make sure you have a copy of your passport/visa/NOA1 (proof you’re undergoing the AOS-EAD-AP process) with you. This applies to ALL NON-US Citizens, and yes, that includes tourists. You are REQUIRED to have evidence of your legal presence here in the United States AT ALL TIMES. No ifs. No buts. No exceptions. If you don’t, there may be sanctions: a $100 fine or 30-day jail time or both. This is clearly stated on Section 264(e) of the Immigration and Nationality Act (INA). *** Note: Keep a photocopy of your Permanent Resident Card, Passport/Visa, NOA1, and other important paperwork in a safe place, not the other way around.
