Can I still file for Adjustment of Status (AOS) even after my I-94 expires?

Yes you can. But that doesn’t mean you should delay your Adjustment of Status (AOS) process. You must apply as soon as possible. Preferably, K1 Visa Holders must adjust their status immediately before the I-94 expires.

Why?

Because, technically, that would be your only document of your legal presence here in the U.S. after entering on a K1 Visa. The K1 Visa is invalidated the moment you step in the United States. It’s a single-entry visa. The I-94 is your Arrival/Departure Record denotes the date until when your stay in the U.S. is considered legal.

The sooner you apply for AOS/EAD/AP, the sooner you will get your EAD/AP Combo Card. And that very same card will be your document of legal presence here in the U.S. (valid for a year) until your 2-year I-551 Permanent Residency Card / Green Card arrives after an AOS approval.

    Yes have a question me and my wife got married, but we forgot to file for SSC before her 90 days was up. Will that have any problems of filing my AOS. I do have her on my electric bill and our cable bill and i do have her on my insurance. I would have her on my bank account but as all banks they required a SSN. So how would i go about this.
