Form I-134: Is it really 125% of the Poverty Guidelines? or 100%?

For the K1 Visa Process, the petitioner is required to have an annual income of 100% not 125% of the HHS Poverty Guidelines.

The 125% is for the Affidavit of Support, Form I-864, that you’re supposed to use for Adjustment of Status.

 

 

The answer was also mentioned on U.S. Embassy Manila’s blog, The VISAtisfied Voyager:

“…petitioners should be able to demonstrate their ability to maintain an income of at least 100% of the federal poverty guidelines for their prospective household sizes.”

    hi mrs presson,

    Im a k1 visa applicant and I have an upcoming interview for the K1 visa.I have been reading the internet about the interview process and i was able to identify that i do have ‘ 2 red flags’ namely:

    – i have tried to apply for a tourist visa once and this was denied

    – my fiance was initally introduced to me by a relative

    Any assistance on these will be greatly appreciated. Thank you.

      Please mind the article that you’re posting the comment on. This article is not about red flags.

      You might want to discuss your case with an immigration lawyer. A professional who knows more about red flags should be able to help you out.

    Hi there,

    I find your blogs to be very helpful but I just have a quick question that I’m hoping you can help me with. My fiancè’s tax returns for the past 2 years are barely above the 100% poverty guidelines. But last year in November, he got a better paying job which puts him a little over the 125% mark. At the interview, will they be looking at the tax returns? Or will they base their decision on his current income?

        Good day Mrs. Presson were about to start our K1 visa. My concern is does my fiance need his recent Federal Tax when he file his petition? or Federal Tax only be needed during interview… thank you
