My fiancé(e) and I are having problems. My 90 days is almost up, and we’re still not married yet. What do I do?

One, it’s an issue you and your fiancé(e) must deal with on your own.

Two, K1 Visa holders are only given until the I-94 expiration date (90 days upon U.S. entry) to get married to (and only) their petitioners.

Three, if you can’t work things out with your fiancé(e), my sincerest apologies but you must leave the U.S. and back to your home country.

 

Those have been clear right from the get-go. Those are the conditions of having a K1 Visa. Get Married or Go Home.

The I-94 is your only document of your legal presence in the U.S. If it expires and you’re still not married yet, you are technically an illegal alien.

 

There is no valid reason in breaking immigration laws. There is no valid reason in breaking ANY laws. Period. 

Breaking these immigration laws can lead to deportation, a ban from ever entering the U.S. ever again, and/or could affect future eligibility for U.S. immigration benefits.
